This End User License Agreement ("EULA") is a legal agreement between you ("User") and Stephen Wise Temple, a California non-profit corporation ("Licensor"). By downloading, installing, or using Spirit Of Shabbat ("Application"), you agree to this EULA. If you do not agree, do not use the Application.
This EULA supplements the . Where terms overlap, the Terms of Service govern general Platform use; this EULA governs the Application software license specifically. Defined terms not redefined here have the meanings given in the Terms of Service.
Subject to this EULA, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on devices you own or control, for personal, non-commercial purposes.
You may not copy, modify, distribute, reverse engineer, decompile, sublicense, sell, rent, or create derivative works from the Application. You may not circumvent security features, use automated tools, exploit vulnerabilities, or use the Application in violation of law. You may not use it to develop competing products.
The Application is licensed, not sold. All intellectual property rights remain with Licensor, including source code, design, graphics, trademarks, and trade secrets.
You retain ownership of content you create. By submitting content through the Application, you grant Licensor the license described in the .
Feedback you provide becomes Licensor's property and may be used without obligation to you.
Points, badges, achievements, and other virtual rewards are part of the licensed Application, have no monetary value, are non-transferable, and may be modified, forfeited, or discontinued at any time. You have no property interest in them. See .
Licensor may release updates that add, modify, or remove features, fix bugs, or change system requirements. By installing the Application, you consent to automatic updates. Disabling auto-updates may affect functionality.
Licensor may modify, suspend, or discontinue the Application or any feature at any time without liability.
Your use is subject to our . The Application may collect account information, usage data, device information, location data (with permission), content, and communications. We use this data to provide, improve, and secure the Application and comply with law.
California residents have specific rights under CCPA/CPRA. See the Privacy Policy for details.
The Application is a web-based Progressive Web App (PWA) requiring:
PWA installation is optional and enables offline features on compatible devices. Compatibility is not guaranteed across all devices or configurations. You are responsible for maintaining your browser, device, and internet access, and for any associated costs.
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, UNINTERRUPTED OPERATION, OR FREEDOM FROM HARMFUL COMPONENTS. YOUR USE IS AT YOUR SOLE RISK.
Liability exclusions, caps, and related terms are as stated in the and apply equally to this EULA.
You may terminate by deleting the Application and requesting account deletion. Licensor may terminate at any time, with or without cause. Upon termination, your license ends immediately, you must cease use and delete the Application, and Virtual Items are forfeited. Sections 2 (Ownership), 8, 9, and any provisions that by nature should survive, will survive.
Dispute resolution, arbitration, class action waiver, jury trial waiver, and governing law terms are as stated in the and apply equally to this EULA.
BY DOWNLOADING, INSTALLING, OR USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THIS EULA.
