Legal Framework

We operate under Section 230 of the Communications Decency Act, the DMCA (17 U.S.C. § 512), the CCPA/CPRA, federal and California child exploitation laws, and California Penal Code provisions regarding threats, harassment, and intimate images. Section 230 protects our right to moderate content in good faith.

3. Prohibited Content

The following content is prohibited regardless of the medium, method of creation, or technology used to produce it.

3.1 Absolute Prohibitions — No Exceptions

Content in this category results in immediate permanent ban and may be reported to law enforcement:

  • Child sexual abuse material (CSAM) — any sexual or suggestive depiction of a minor, by any method including AI-generated
  • Non-consensual intimate imagery (NCII) — intimate images shared without consent, threats to share, or secretly captured intimate images (illegal under California Penal Code § 647(j)(4) and Civil Code § 1708.85)
  • Credible threats of violence — specific, actionable threats against individuals or groups
  • Terrorism content — promoting, recruiting for, or glorifying terrorist acts
  • Trafficking or exploitation — facilitating human trafficking, forced labor, or exploitation
  • Doxxing — exposing private information to enable harassment

3.2 Prohibited Content Categories

  • Violence and incitement — glorifying, instructing, or encouraging violence

  • Sexual content — pornography, nudity, sexual solicitation
  • Hate speech — attacks on individuals or groups based on protected characteristics, slurs, dehumanization, genocide denial, supremacist content
  • Harassment and abuse — targeted attacks, coordinated harassment, bullying, shaming
  • Self-harm promotion — encouraging self-harm or suicide, sharing methods, glorification
  • Misinformation — health misinformation that could cause harm, manipulated media presented as authentic, fraud, impersonation
  • Illegal content — any content illegal under federal, California, or local law
  • Spam — bulk messaging, coordinated inauthentic behavior, unauthorized commercial content

3.3 Context-Dependent Content

The following may be permitted with appropriate framing and content warnings:

  • Historical violence or persecution for educational purposes
  • Medical or health education with necessary clinical imagery
  • News coverage of significant events
  • Recovery discussions and survivor stories focused on healing
  • Satire and parody when clearly labeled
  • Classical art and sculpture

Content Warning Format: CW: [Description] at the beginning of the post, with sensitive content behind spoiler tags.

3.4 AI-Generated and Synthetic Media

AI-generated content is subject to the same standards as any other content. Additionally:

  • Permitted AI-generated content must be clearly labeled [AI-Generated] or [Synthetic Media]
  • AI-generated CSAM is treated as CSAM
  • Deepfake pornography is treated as NCII
  • Synthetic media presented as authentic is prohibited as misinformation

The technology used to create harmful content does not change whether it is harmful.

4. Child Safety

We maintain absolute zero tolerance for child exploitation. The Platform requires all users to be 18+.

Mandatory Reporting

Under 18 U.S.C. § 2258A, we report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) within 24 hours via CyberTipline. Reports include the content, account information (email, IP, device info), relevant communications, and timestamps. We fully cooperate with subsequent law enforcement investigations.

Detection

We use hash-matching (PhotoDNA), AI detection, trained human review, community reporting, and behavioral analysis to identify CSAM and grooming behavior.

5. NCII Victim Support

If you are a victim of non-consensual intimate imagery:

  • Report to safety@spiritofshabbat.org — we will expedite removal (goal: within 24 hours)
  • You will not be required to view the content to report it
  • We will permanently ban the responsible account, preserve evidence, and cooperate with law enforcement at your request
  • Referrals to victim support organizations are available
